Probate

Probate is the legal process involved in transferring a person's assets after death. It involves filing with the court, executing any valid will, paying creditors of the estate and collecting on debts owed to the estate, and distributing property to heirs or beneficiaries.

Ancillary Probate: We work with heirs and beneficiaries from across the country who need help probating an estate in Oklahoma. Among the unique aspects of ancillary probate in our state is the need to help heirs negotiate mineral rights and oil and gas leases. (Learn more about our oil, gas and energy law services ).

Estate Administration

Not every estate plan requires probate. For some property situations, including when most assets are held in a trust, estate administration is all that's needed to complete the transfer of property to heirs. We also help with the administration of trusts.

Estate Litigation

There are a number of problems that can arise with wills, trusts, or even with the financial management of a person's estate before death. A retired person may have been the victim of elder financial abuse from a caregiver. The retiree may have been incompetent to write or change a will. The instructions in a will may be vague or unenforceable.

If you need help understanding and enforcing a will or you want to hold an executor, trustee or someone else responsible for financial mismanagement, contact the probate attorneys at Frailey, Chaffin, Cordell, Perryman, Sterkel & McCalla LLP.
